Comment Deadlines Extended in FCC Rulemaking to Require National EAS Testing

     In January, the FCC released a Second Further Notice of Proposed Rulemaking (“Second FNPRM”) proposing changes to its rules governing the Emergency Alert System (“EAS”) to provide for national testing of the EAS and collection of data from such tests (see our “Memorandum to Clients” dated January 19, 2010).  Although comment and reply comment deadlines were later established as March 1 and March 30, 2010, respectively (see our “Memorandum to Clients” dated February 1, 2010), the FCC recently extended the comment period in response to a Motion for Extension of Time filed by the National Association of Broadcasters.  Under the new deadlines adopted by the FCC, comments are now due on or before March 15, 2010 and reply comments on or before April 13, 2010.
