This is a reminder that as of December 31, 2006, digital cable systems are required to comply with all of the FCC's Emergency Alert System ("EAS") obligations in Part 11 that are currently applicable to analog and wireless cable systems. Those portions of cable systems delivering channels to subscribers in a digital format must participate in national level EAS activations and any required testing. Participation in state and local level activations is voluntary; however, digital cable providers that choose to participate in such activations must comply with the FCC's EAS rules in all other respects.
Furthermore, digital cable providers must ensure that all viewers receive the complete EAS message either by providing EAS messages on all digital channels or transmitting EAS messages on a single channel and force tuning all receivers to that channel. Cable systems with fewer than 5,000 digital subscribers, like analog and wireless cable systems with fewer than 5,000 subscribers, must provide both a video interruption and audio alert message on all digital channels while transmitting the EAS message on at least one channel.
