EEO Form 396-C Due September 30, 2009

      As a reminder, by September 30, 2009, all cable “employment units” must prepare and file electronically at the FCC, through the Commission’s CDBS filing system, a Multi-Channel Video Programming Distributor Equal Employment Opportunity (EEO) Program Annual Report on FCC Form 396-C.  The Report requires cable employment units with six or more full-time employees (“FTEs”) to complete a series of certifications regarding compliance with the FCC’s rules governing EEO.  Cable employment units with fewer than six FTEs must provide only basic information on the Report form.  Hard copies of the completed Reports must be placed in each system’s public inspection file. 

Additionally, employment units on the attached list also must complete a Supplemental Investigation Sheet (“SIS”).  Units that are on the list must check the box in Section I of the Form 396-C next to the statement “Supplemental Investigation Sheet attached.”

Units filing the SIS must provide three job descriptions, but only for the “Technicians” category (Part I, Item 3).  On Part II of the SIS, only questions 3, 5 and 6 must be answered.  Part III requires the submission of the unit’s EEO public file report created in 2009 covering the previous 12 months.
