The FCC is seeking comment on requests filed by Evolution Broadband, LLC (“Evolution”) and FutureWei Technologies, Inc. d/b/a Huawei Technologies (USA) (“Huawei”) seeking waiver of the set-top box integration ban for certain low-cost, limited capability devices pursuant to streamlined procedures adopted by the Commission in its June 1, 2009 Evolution Broadband decision.  Under those procedures, if applicants can certify that their navigation devices are low-cost, limited-capability devices that are no more advanced than the Evolution Broadband DMS-1002 and DMS-1002-CA set-top boxes, the Media Bureau initiates a 10-day public comment period regarding those certifications, after which it takes expeditious action with respect to the requests.

Evolution and Huawei have filed waiver requests pursuant to this streamlined process, certifying that the following set-top box models meet the established criteria:

  • Evolution: DMS-2002-CA, DMS-1004-CA and DMS-2002u
  • Huawei: DC-730 and DC-732

Comments and oppositions in these proceedings are due October 8, 2009.  We would be pleased to respond to any questions regarding these matters.
