New Terrestrial Program Access Rules Now in Effect

     This past January, the FCC adopted a Report and Order to close the so-called “terrestrial loophole.” (see our “Memorandum to Clients” dated January 22, 2010).  The Order expands the FCC’s program access rules to allow complaints regarding cable-affiliated programming that is distributed by terrestrial means.  This week, the FCC announced that the Office of Management and Budget has approved the complaint-related rules and that as of June 21, 2010, all rules from the January Order are now in effect.
